The Portuguse international was given an improper conduct charge after his behaviour towards the away fans in the match on January 10.
However the FA have reviewed the case and revealed that the accusation is "not proven."
Boa Morte must wait to see if Toffees striker Duncan Ferguson will face action after the winger claimed the Scot has made racial comments towards him.
FA officials have been looking into the incident for the past six weeks but are still believed to be some way off announcing a decision.
Meanwhile, both Ricardo Fuller and David Weir lost their appeals for wrongful dismissal.
Preston North End forward Fuller was sent-off against Burnley for violent conduct and his four-match ban will stand.
Weir was given his marching orders in a reserve team game for the same offence and the Everton man also had his punishment upheld.
