The striker moved to Boundary Park in the summer, but the clubs could not come to agreement over a compensation package.
Now a Football League tribunal have ordered The Latics to pay £50,000 up front with a further £25,000 to be paid after 15 and 30 league appearances.
Bury will also be due 15 percent of any transfer fee Oldham may receive in the future.
Both sides stressed their satisfaction at the outcome.
"Chris could develop into a very special player and I think we have a bargain," said Oldham boss Ronnie Moore.
"He had only been at Bury for a couple of years and didn't come through their ranks. I am sure that was taken on board when the decision was made."
Bury manager Graham Barrow added: "I thought it was a very fair hearing and we are obviously delighted by the outcome.
"I have to thank Chris Porter for the effort and commitment he showed me during his two years with us, I wish him nothing but the best for his future."
