Simao is reported to have left Camp Nou for Benfica, but Sporting are unhappy with this move.
The Portuguese outfit sold Simao to the Catalan giants two years ago and they claim they had a clause in his contract stipulating that if Barca sold him they would have first refusal on buying him back.
Barcelona reportedly faxed Sporting to let them know of Benfica's interest, but Sporting claim they have not received it and that Barca are not allowed to sell him otherwise.
"As that fax never arrived in Alvalade, the seven days period in which Sporting is supposed to decide if it wants to activate the first choice right, hasn't started yet," said Sporting's plc manager Miguel Ribeiro Telles.
"If there is a deal we have to receive a fax.
"If the deal goes through and we do not get the fax statingits terms and details, we can solve this matter in court," added Ribeiro Telles.
