The Rennes striker was initially investigated after German broadcaster ZDF made available footage which appeared to catch him spitting at Gerrard's neck.
The Swiss hit-man was, though, cleared by Uefa's disciplinary panel on Sunday after an investigation revealed a lack of evidence.
However, just hours after the decision was taken, fresh footage from Swiss broadcaster SF DRS provided compelling new evidence that Frei had indeed spat at the Liverpool star after brushing past him.
Uefa have yet to reveal whether Frei will be suspended from his side's final Group B match against France on Monday evening, but the player is sure to face hefty punishment.
Italy's Francesco Totti was banned for three matches after being found guilty of spitting at Denmark's Christian Poulsen earlier in the tournament.
