Real Betis are to allow Johan Vogel to leave the club for free in January and Everton are poised to land the Swiss international, skysports.com understands.

The 30-year-old midfielder almost joined Everton in the summer but the deal failed to materialise as problems arose at Betis' end.

Vogel, who moved to Seville in 2006 as part of the deal that took Ricrado Oliveira to Milan, has since found himself frozen out by coach Paco Chaparro and he has not played a single game this season.

Betis and Vogel were set to go to a tribunal over unpaid fees as the player looked to get himself freed.

Now his lawyer Juan De Dios Crespo has confirmed that the two parties have agreed to a parting of the ways - six months before his contract was due to expire.

"With this we have eliminated the need for tribunals, Vogel just wants to play this season," he explained to skysports.com.

Vogel is desperate to get back playing regular football as he looks ahead to the finals of Euro 2008, where he hopes to be one of Switzerland's key players.

Everton are now set to end Vogel's Spanish nightmare and take him in January.

"My experience in Spain was bad," Vogel admitted.

"I now desire a club that I can demonstrate myself and give me those chances for Euro 2008."

There is also interest from the Bundesliga, but Vogel confirmed he wanted to move to England adding: "For me the Premier League has always been very attractive."
