Litigant will now head to Ascot for the Qipco British Champions Long Distance Cup on Saturday week after being a late withdrawal from the Prix du Cadran at Longchamp.

Joe Tuite took the tough decision to take the seven-year-old, who defied a 16-month absence to win the Betfred Ebor at York, out of the Group One stayers' contest because of the fast conditions.

"The ground was too quick. If we knew what it was going to be like, we'd never have gone," said the Hungerford trainer.

"It's hard to take him out on the day when you're there. It was a tough decision. The easy one is to take your chance, but I know I made the right decision. I've just got to go and prove it now.

"When you go two and a half miles on fast ground, you're going to do damage.

"We're going to Ascot now on Saturday week. We'll have a fresh horse as well and he'll go there and put up a bold show.
