The Layer Road club have also been advised that not to launch an appeal for John after authorities told The U's that it too would be turned down.
The Home Office rejected the 27-year-old's application because he had not played enough internationals for his country to qualify for a work permit and with that, his proposed move to Steve Whitton's side will not go through as planned.
John was keen to join the Essex club after a successful pre-season trial spell with the Division Two outfit but he will be forced to move on with his deal to stay now dead.
Whitton told the Colchester United official website:"It is obviously very disappointing because we were pleased with what we'd seen from Avery in pre-season.
"His agent was unaware that he had not played the necessary percentage of internationals, so this has come as a surprise.
"We have spent considerable amounts of time and money pursuing Avery's work permit, so it's frustrating that it has come to nothing.
"The fact that we don't offer long contracts or pay big money at Colchester was also a factor in the player not coming."
Meanwhile, defender Joe Dunne has offered to forfeit his wages for September in order to fully recover from his knee troubles.
The 29-year-old Irishman recently had an operation to try and resolve the problems with his knees but the veteran has proposed to forego a month's pay in order to overcome his injury nightmare.
Dunne told the Evening Gazzette: "I am currently operating on a monthly contract, so I have put forward the idea of forfeiting my wages for September to remain at home and give myself the best chance.
"There is no telling what damage I could causing during my rehab programme if I am having to drive an hour and a half each way to and from training every day.
"The manager and the club have agreed to my offer and I remain positive that I will be back."
In other news, Newcastle striker Lomano Tresor Lua Lua has praised his former club in helping him with his progress as a player.
The former Colchester trainee joined The Magpies from in a £2.25 million move in September 2000 but has only recently made the headlines with his fine displays for Sir Bobby Robson's side.
Lua Lua got two goals and took the Man of the Match award on Monday as Newcastle started their season with a 4-0 victory against West Ham at St James' Park.
The 21-year-old showed his appreciation to the Layer Road side and is thankful they gave him a chance to develop at the Essex club.
Lua Lua said: "Colchester was my first love - I miss Colchester.
"When I was playing for their youth team and reserves, Mick Wadsworth was the coach at the club.
"He gave me my chanceǪ and from there I've never looked back and I thank the Lord for giving me this chance which I am determined to take."
