Inter Milan striker Adriano will not be punished after scoring the opening goal in Sunday's 2-1 win over AC Milan with his arm.
The Italian league's disciplinary unit reviewed video evidence of the incident and announced on Tuesday that there was insufficient proof of deliberate intent.
Brazilian striker Adriano could have been facing a two-game suspension if the disciplinary unit had ruled against him over the goal, when the ball came off his head and then hit his arm from Maicon's cross in the 29th minute.
Fiorentina's Alberto Gilardino was banned for two games after it was decided he had deliberately handled to score in a 3-1 win over Palermo.
Jose Mourinho's men moved nine points clear at the Serie A summit after victory over their city rivals, who are now 11 adrift.
Eyes to see
Inter president Massimo Moratti claimed the champions would have won despite Adriano's controversial opener, but Milan coach Carlo Ancelotti felt the incident was crucial.
Milan chief executive Adriano Galliani kept his counsel as Ancelotti's men flew out for Wednesday's Uefa Cup game with Werder Bremen.
He said: "Many successes have taught me to stay quiet when we lose and let those who win speak. But everyone has eyes to see..."
Adriano had only just returned from a three-match ban for throwing a punch in the 1-0 win over Sampdoria, where he scored the only goal of the game.
